Asylum: Common Questions Answered

What are the five grounds for asylum in the United States?
To qualify for asylum, you must show persecution or a well-founded fear of persecution on account of race, religion, nationality, political opinion, or membership in a particular social group. The persecution must be carried out by the government or groups the government cannot or will not control.
Affirmative asylum is filed proactively with USCIS by individuals not in removal proceedings, within one year of arrival. Defensive asylum is raised as a defense in immigration court by individuals already in removal proceedings. The legal standards for eligibility are the same in both cases.
You must generally file your asylum application within one year of your most recent arrival in the United States. Limited exceptions exist for changed or extraordinary circumstances, but these are narrowly construed. Filing on time is critical.
If asylum is unavailable, you may still qualify for withholding of removal or Convention Against Torture (CAT) protection. These do not lead to a green card, but they prevent your removal to a country where you face serious harm or torture.
