INTERNATIONAL STUDENT IMMIGRATION

F-1, M-1 & J-1 Student and Exchange Visas

The United States welcomes over one million international students each year. Whether you are pursuing a bachelor’s degree, a graduate program, a vocational certificate, or a cultural exchange, you need the correct visa category — and guidance to maintain it throughout your stay.

Our immigration attorneys advise students from initial visa applications through graduation, post-study work authorization (OPT/STEM), and transitions to long-term immigration status. We also represent students facing SEVIS terminations, status violations, and school transfer issues.
Maintain your status. Failure to maintain full-time enrollment, unauthorized work, or missing a SEVIS check-in can result in immediate status termination and jeopardize your ability to remain in the U.S. When in doubt, consult an attorney before taking action.

Student Visas: Common Questions

What is the F-1 student visa?
The F-1 visa allows foreign nationals to study full-time at accredited U.S. academic institutions. Students must maintain full-time enrollment and valid SEVIS status. The visa is issued for the duration of your program (D/S) and allows for limited on-campus employment plus OPT/CPT work authorization.
F-1 students may work on campus up to 20 hours per week while school is in session. Off-campus work requires specific authorization: CPT for curriculum-integrated internships, and OPT for post-graduation work in your field of study. STEM graduates may extend OPT by 24 months.
CPT is work authorization for internships or co-ops that are part of your academic curriculum and must be arranged before starting work. OPT is work authorization available to F-1 students before or after graduation, up to 12 months (extendable 24 months for STEM degrees), for work related to your major field of study.
A SEVIS termination means your F-1 status is no longer valid. You may be able to apply for reinstatement if the violation was not willful, you have been in valid status for the past 5 months, and you have not worked without authorization. In some cases, departing and re-entering may be a better option than reinstatement. Consult an attorney immediately.
